Terms of Service

Last updated September 25, 2026

These terms apply to every project and service from BrilliantLabsPh Solutions, the digital arm of Penfix Advertising and Business Solutions, San Fernando, Pampanga, Philippines. By approving a quotation or using the client portal, you agree to them.

Your project agreement comes first

Every project starts with a written quotation or agreement that sets out its scope, price, timeline and payment schedule. These terms cover everything around it. Where the two differ, your project agreement wins.

Scope and changes

We build what the approved scope describes. Features, screens or integrations outside it are handled as change requests: we tell you the effect on price and timeline, and nothing changes until you approve it. Approvals, sign-offs and scope changes are recorded in your client portal.

What we need from you

  • Content, logos, data and access to accounts or systems the project depends on.
  • Feedback and approvals within the time agreed for each stage.
  • One point of contact who can make decisions for your side.

When these arrive late, the timeline moves by the same amount.

Payments

Amounts and due dates follow your project agreement. Work begins once the down payment is received. If an invoice is overdue, we may pause work until it is settled, and the timeline moves accordingly. Refunds and cancellations are covered by our Payment & Cancellation Policy.

Ownership and your licence

BrilliantLabsPh keeps ownership of the software we build, including its source code, designs, and the reusable modules and systems behind it. Once your project is paid in full, you receive a non-exclusive, non-transferable licence to use the delivered system for your own business, for as long as you keep to your project agreement.

You may not resell, sublicense, copy or redistribute the system or its code, or build a competing product from it, without our written consent.

Your data stays yours. The content you give us and the records your business keeps in the system, such as your customers, transactions and files, belong to you. You can ask for an export of them at any time.

Support, hosting and third-party services

Support, maintenance and hosting are provided as set out in your package or agreement. Where a package includes support hours, unused hours do not roll over unless the package says so.

Systems may rely on third-party services such as hosting, domains, email or payment providers. Their fees are billed as agreed, and we are not responsible for their outages or changes to their terms, though we will help you work around them.

Fixes and limits of liability

If the delivered system does not work as the approved scope describes, tell us and we will fix it within the support period in your agreement. Beyond that, our total liability for any claim is limited to the amount you paid for the specific service the claim relates to. We are not liable for indirect losses such as lost profits or lost business.

Confidentiality

We keep your business information confidential and use it only to deliver your project. We may mention that we worked with you, or show the finished work in our portfolio, only with your permission.

Client portal accounts

Keep your sign-in details private. You are responsible for the people you give access to, and for telling us when someone should lose it.

Ending a project, changes and governing law

Either side may end a project by written notice. What happens to payments is set out in the Payment & Cancellation Policy. We may update these terms; the version in force when you approved your quotation applies to that project. These terms are governed by the laws of the Republic of the Philippines.
